When a driver fails or refuses to submit to a breath or a blood test, his or her license is automatically suspended. This takes effect 40 days after the driver was asked to provide a breath or blood specimen. A suspension can be prevented if the person or their attorney requests a license suspension hearing within 15 days of his or her arrest. If a hearing is requested, no action will be taken regarding suspension until after a hearing has taken place.
